Well, depends on the state. It just so happens I recently had my vehicle (not my Z) towed and had to consult an attorney (lucky my sister is one) and she faxed me the towing statute for FL (where I live). The statute is very specific and outlines everything. If you were in FL, he would have to release the vehicle to you, but you might have to pay for his services. If you couldn't pay, then he could still tow the car.
It depends also on whether it was being towed by the request of the police or by request of a private party (such as a business). I don't know where you are, but my suggestion is to get a copy of your state's statute. Hope that helps.
